Metcash User Content Submission Terms and Conditions

When you submit content to us via our website or social media channels (or otherwise), these Terms and Conditions will apply:

1. All content submitted by you (such as photograph(s), image(s), drawing(s)/illustration(s), comment(s), sound/video recording(s), written works, social media names, and/or handles and other data and information) must NOT: (a) be in breach of any laws, regulations and rights (including copyright), defamation and privacy; (b) be objectionable in any manner or generally unsuitable for publication; (c) be false or misleading; or (d) contain any viruses.

2. By submitting any content, you must either own or have the right to license the copyright in the content (and there must be no third party with any rights to the content which would prevent our use/reproduction of the content).

3. You must ensure you have consent from any person (or from the owner(s) of any intellectual property) that appears or features in the content.

4. By submitting the content, you license and grant us and our affiliates a royalty-free, perpetual, worldwide, irrevocable, and sub-licensable right to use, reproduce, modify, adapt, publish and display your content (including any part of the content) for any purpose, including future promotional, marketing or publicity purposes, in any media without compensation, restriction on use, attribution or liability. We may adapt, edit or change the content if necessary for our purposes.

5. If we are interested in exclusive rights in your content, we will ask if you are happy to assign your rights, title and interest in and to the content (and sign any related legal documentation).

6. Please only submit content which is your original work (which does not infringe the rights of third parties). If you do submit content which has been jointly or partly created by someone else, make sure you have their consent to submit the Content.

7. You are responsible for all content submitted and we will not be liable for any claims regarding any content, to the extent permitted by law.

8. We may need to remove selected content from time to time, including if the content is in breach of these Terms and Conditions. If your assistance is required to do this, we will reach out to you.

9. By submitting content to us, you agree that the content will not infringe any copyright, trademarks or other intellectual property rights of any third party (including moral rights) and that you have all rights necessary to grant us the right to use the content. You agree to indemnify us for any breach of these Terms and Conditions including this clause.

10. You must be 18 or over (or otherwise have consent from a parent or guardian) to submit content.

11. We may collect any personal information that is contained in the content (or provided in conjunction with the content) and if we do, we will use and handle personal information as set out in our Privacy Policy, which can be viewed at https://www.iga.com.au/privacy/.
